Minimum Training Requirements for Entry-Level Commercial Motor Vehicle Operators
This effects Appendices A → F to Part 380, Subpart E and new Subparts F, and G plus §§383.71, 383.73, 384.230, 384.236, and 384.301.
Delayed three times in 2017, this final rule is now in full effect as of June 6th, 2017.
New minimum training standards are provided for certain individuals
- applying for their commercial driver's license (CDL) for the first time;
- an upgrade of their CDL (e.g., a Class B CDL holder seeking a Class A CDL); or
- a hazardous materials (H), passenger (P), or school bus (S) endorsement for the first time.
The compliance date for this rule is February 7, 2020.
The original FR update (81 FR 88732) specified the revision of the title for Subpart E and its future status of [Reserved] on the compliance date of February 7, 2020, whereby Subpart E will be removed and reserved and replaced by new Subparts F and G.
Commercial Driver's License Drug and Alcohol Clearinghouse
This effects relevant Sections in 49 CFR Part 382 Controlled Substances And Alcohol Use And Testing and §§383.73, 384.235 and 391.23.
49 CFR G Requirements and Procedures for Implementation of the Commercial Driver's License Drug and Alcohol Clearinghouse was added in its entirety.
Regulations were added and revised to establish requirements for the Commercial Driver's License Drug and Alcohol Clearinghouse (Clearinghouse), a database under the FMCSA's administration that will contain information about violations of FMCSA's drug and alcohol testing program for the holders of commercial driver's licenses (CDLs).
The compliance date for these regulations is January 6, 2020.
This rule is mandated by the Moving Ahead for Progress in the 21st Century Act (MAP-21). It aims to improve roadway safety by identifying commercial motor vehicle (CMV) drivers who have committed drug and alcohol violations that render them ineligible to operate a CMV.
Unified Registration System; suspension of effective date and temporary final rule with added temporary sections.The Unified Registration System final rule (URS 1 final rule) was originally issued on August 23, 2013. The original effective and compliance dates were October October 23, 2015 with limited exceptions.
Note: The 2013 URS final rule was issued to improve the registration process for motor carriers, property brokers, freight forwarders, Intermodal Equipment Providers (IEPs), hazardous materials safety permit (HMSP) applicants and cargo tank facilities required to register with FMCSA, and streamline the existing Federal registration processes to ensure the Agency can more efficiently track these entities.
On October 21, 2015, a subsequent final rule delayed the implementation of the URS 2013 final rule to September 30, 2016 in order to allow FMCSA additional time to complete the information technology (IT) systems work.
On July 28, 2016, a third final rule regarding regulations to implement the URS system further delayed the effective and compliance dates to January 14, 2017 with several exceptions. This rule also corrected regulatory provisions that had not yet gone into effect in addition to several temporary sections that were already in effect. This delay intended to allow to allow FMCSA sufficient additional time to complete the information technology (IT) systems work.
On January 17, 2017, FMCSA issued a fourth final rule regarding the URS regulations. It suspended the effective date indefinitely and added complementary temporary final rules. During this suspension, entities needing to file are instructed to follow the same procedures and forms used to submit information to FMCSA as they do as of January 17, 2017.
The FMCSA intends to lift the suspension once the technology to implement electronic on-line URS 1 is complete, and effectively replace the temporary regulations with the URS 1 final rule.
Amendments To Implement Grants Provisions of the Fixing America's Surface Transportation ActConforming changes to FMCSRs are made to ensure they are current and consistent with the statutory requirements that went into effect on October 1, 2016. These changes are made to maintain compliance with the Fixing America's Surface Transportation Act (FAST Act) enacted on December 4, 2015.
