§1206.366 — What is the nominal fee that a State, tribal, or local government lessee must pay for the use of geothermal resources? If a State, tribal, or local government lessee uses a geothermal resource without sale and for public purposes — other than commercial production or generation of electricity — the State, tribal, or local government lessee must pay a nominal fee. A nominal fee means a slight or de minimis fee. ONRR will determine the fee on a case-by-case basis.
