§40.399 — How does the Department notify service agents of its decision? If you are a service agent involved in a PIE proceeding, the Director provides you written notice as soon as he or she makes a PIE decision. The notice includes the following elements:
(a) If the decision is not to issue a PIE, a statement of the reasons for the decision, including findings of fact with respect to any material factual issues that were in dispute. |
(b) If the decision is to issue a PIE — (2) A statement of the reasons for the decision, including findings of fact with respect to any material factual issues that were in dispute; |
(3) A statement of the scope of the PIE; and |
(4) A statement of the duration of the PIE. |
